W opracowaniu przeanalizowano system podejmowania decyzji administracyjnych przedsiębiorstwa rolnego pod względem jego funkcjonowania w przestrzeni informacyjnej. Sformułowano warunki funkcjonowania systemu i wyjaśniono ogólne etapy składowe systemu. Zdefiniowano kierunki strumieni informacyjnych i określono rolę czynników wpływających na skuteczność całego systemu.

Regulation issues of algorithmic administrative decisions: looking for an Italian legislative model

The work aims to highlight the most relevant problematic points that should be taken into consideration by the Italian legislator in order to introduce a regulation of automated administrative decisions. After having briefly recalled the current legal framework on the digitalization of administrative acts and the main doctrinal theories on this subject, the significant positions espressed in the recent administrative case law are examined. With the intent to discuss possible regulatory measures, the main legislative and interpretative solutions developed in this regard in the French legal system are also analyzed.

The presented gloss to the resolution of the Supreme Administrative Court in Warsaw of 11 June 2018 (I OPS/17) is approved. The problems presented by the court are very complicated, the main one concerning the question in what form the obligation of paying for a stay in a social welfare home should be settled. In the Court’s opinion, the obligation to pay is due to the act, but it is necessary to issue a decision or enter into a contract in order to fulfill the obligation
